1. Introduction

These Terms of Service (“Terms”) govern the relationship between Dong Santos, a web developer (“Developer”), and clients (“Client”) who utilize the Developer’s services for website development. These services include, but are not limited to, e-commerce, portfolio, services, LMS, coaching, and appointment booking websites.

2. Services Offered

The Developer offers website development services, including design, development, and implementation. The specific services provided will be detailed in a product page before the Client will avail the services.

3. Trial Period

The Developer offers a 30-day trial period for 300 pesos. This trial allows the Client to assess the Developer’s work and the functionality of the developed website. The trial period covers the development of the client-side components of the website. The Client is responsible for reviewing the trial website and providing feedback within the 30-day period. After the trial period, the Client can choose to continue or discontinue the service. No refunds will be issued for the trial period.

4. Lifetime Plan and Pricing

Upon completion of the trial period, if the Client chooses to continue, they may opt-in for the Developer’s lifetime plan. The monthly fee for the lifetime plan starts at 999 pesos and can increase based on the Client’s specific needs and the complexity of the website’s ongoing maintenance and support requirements. The Client and Developer will agree upon a specific monthly fee.

5. Contract Term

The lifetime plan requires a minimum two-year contract. Either party may terminate the contract with written notice 30 days prior to the end of the two-year period or any subsequent annual period.

6. Payment Terms

Payment for the trial period is due upon commencement of the service. Monthly payments for the lifetime plan are due on the first day of each month. Late payments may receive as email reminders but if no response within in Two (2) Months it may subject to terminate the Services.

7. Intellectual Property

The Client retains ownership of all content provided to the Developer for the website. The Developer also retains responsible for Pro themes, Pro plugins and design templates unless the client will initiate to pay/provide it.

8. Confidentiality

The Developer agrees to maintain the confidentiality of all Client information obtained during the period of the project.

9. Limitation of Liability

The Developer’s liability for any damages arising from the use of the website or the Developer’s services is limited to the total amount paid by the Client under this agreement.


10. Dispute Resolution

Any disputes arising from this agreement will be open for suggestions via email at info@dongsantos.com.

11. Entire Agreement

This agreement constitutes the entire agreement between the Developer and the Client and supersedes all prior or contemporaneous communications and proposals, whether oral or written.

12. Changes to Terms of Service

The Developer reserves the right to modify these Terms at any time. The Client will be notified of any changes via email. Continued use of the service after the changes have been implemented constitutes acceptance of the updated Terms.
